TERMS AND CONDITIONS FOR DISCOVER GROUP OF TRAVEL SERVICES INC:

These Terms and Conditions ("Agreement") govern your use of the travel services provided by Discover Group ("Discover," "we," or "our"). By accessing or using our services, you agree to be bound by these terms. Please read this Agreement carefully before proceeding. If you do not agree with any provision of this Agreement, you may not use our services.

DEFINITIONS

"Discover Group" refers to the travel services provided by our company.
"Customer(s)," "passenger", "client", "you," or "your" refers to any individual or entity using our travel services.
"Service(s)" refers to the travel services, including but not limited to flight bookings, hotel reservations, car rentals, vacation packages, and travel insurance, provided by Discover Group.

BOOKING AND RESERVATIONS

By using our services, you acknowledge that Discover Group acts as an intermediary between you and various travel service providers (e.g., airlines, hotels, car rental companies), and your bookings and reservations are subject to the terms and conditions of these providers.

The contact person is the one responsible for the package of all participants listed above.

All bookings and reservations made through Discover Group are subject to availability and confirmation by the relevant travel service providers.

You are responsible for providing accurate and complete information during the booking process. Discover Group is not liable for any errors or consequences arising from inaccurate or incomplete information provided by you.

Changes or cancellations to bookings may be subject to fees imposed by the travel service providers. You agree to comply with their terms and conditions regarding changes, cancellations, refunds, and other related policies.

By using our services, you acknowledge that certain bookings, such as airline tickets and hotel reservations, may be non-refundable and non-re bookable. Once these bookings are made, they cannot be refunded or changed, and no cash surrender value will be provided.

It is your responsibility to carefully review and understand the terms and conditions of the specific bookings you make, as cancellation or change policies may vary depending on the travel service provider. Discover Group of Travel Services will not be responsible for any non-refundable or non-re bookable bookings made by you.

Promotions may not the same for every client. Applicable differences may apply depending on the promotion period of the availed package, number of pax, season and other factors affecting prices of supplies.

All confirmed optional tours by clients are non-refundable, non-transferrable and non-rebookable.

All discounts and complimentary inclusions are subject to specified deadlines. Failure to avail of these within the given period will result in forfeiture, without extension or compensation.

PRIOR AGREEMENTS, AMENDMENTS & NON-WAIVER

This agreement supersedes all previous consideration, understanding, oral or written, agreements and contracts entered into by the parties. No Amendment to this agreement shall be made unless new booking confirmation is issued. No waiver of any right in this agreement by any party shall be construed unless it shall be in writing by the waiving party.

ACCOMMODATION

All accommodation in Europe are based on a 3 star hotel category outside the city center on a deluxe, preferred, easy, advanced tour and a 4 star hotel with "some" city center on a premium tour. In case of unavailability, price increase, or other factors, the company reserves the right to choose any hotel with the same category without prior notice. Any request for room upgrade or transfer to another hotel is subject to availability and any rate difference or additional expenses resulting to said request will be shouldered by the client.

Some hotel charges key deposit before check-in and will return it to client before check-out. This is not included in the package and client must shoulder the said expense. Any hotel incidentals will be shouldered by client. The client understands that the internal process of hotels are not controlled in any way by Discover Group and will not be responsible for the reimbursements if applicable.

ITINERARY

The daily schedule provided is just a guide and may still vary or be subject to change due to weather conditions, traveling pace, water current, fortuitous event, prices increased and other unforeseen circumstances. All places listed in the itinerary will not be interchanged with any other destination, location, or activity unless necessary without prior notice.

Itinerary may interchange including but not limited to point of entry and exit depending on availability of flights, hotels, attractions, and other factors.

Whilst every effort is made to operate this tour as stated in the itinerary, on occasion it may be necessary to make changes to the accommodation, the routing or order of an itinerary. Refunds or compensation will not be payable for alterations to the itinerary or nightly accommodation.

AIRLINE TICKET

Airline Ticket is non-refundable, non-transferable, and any rebooking request is subject to rebooking penalty and fare difference. Availability of new preferred flight is also not guaranteed.

Discover Group reserves the right to change airline depending on availability, schedule preference, and budget restrictions.

Guests who do not pass check-in process/requirement will not be able to refund any unused part of the trip.

Lay-over or connecting flight from point of origin to point of destination may take up to 24 hours. Copy of airline ticket will be given at least 2 days before departure and/or once all participants for the said trip received their visa result and the ticket is issued by partner airline.

Any request of changes in flights may be charged and is on pax's own account.

For land arrangements, Php 30,000 will be deducted to the package rate. The guests will meet the group directly at the first hotel of the group.

TRAVEL DOCUMENTS AND REQUIREMENTS

It is your responsibility to ensure that you have valid travel documents, such as passports, visas, health certificates, and travel authority for government employees required for your travel. Discover Group is not responsible for any consequences arising from your failure to obtain or comply with the necessary travel documents.

You must comply with all applicable laws, regulations, and requirements of the countries you are visiting. Discover Group is not liable for any losses, damages, or penalties resulting from your failure to comply with such laws and regulations.

TRAVEL INSURANCE

We strongly recommend that you obtain travel insurance to protect yourself against unforeseen circumstances, such as trip cancellations, medical emergencies, or lost luggage. The terms and coverage of the insurance policy are determined by the insurance provider, and you agree to review and comply with their terms and conditions.

Discover Group is not an insurance provider. We are not responsible for any claims, disputes, or issues related to the travel insurance policies.

LIMITATION OF LIABILITY - BOOKING AMENDMENTS

Discover Group acts as an intermediary and does not assume any liability for the acts, omissions, errors, delays, or negligence of the travel service providers.

In no event shall Discover Group be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services, including but not limited to loss of profits, data, or goodwill.

Discover Group's total liability, whether in contract, warranty, tort (including negligence), or otherwise, shall not exceed the total amount paid by you for the specific service giving rise to the claim.

INTELLECTUAL PROPERTY

All intellectual property rights related to our services, including but not limited to trademarks, logos, and content, are the property of Discover Group or its licensors. You may not use, reproduce, or distribute any intellectual property without prior written permission from Discover Group.

All digital properties taken during the duration of the trip will be considered a property of Discover Group.

LIMITATION OF LIABILITY - IMMIGRATION

Discover Group of Travel Services shall not be held responsible for any immigration issues, offloading, or similar incidents experienced by the passenger. If you are unable to board a flight or enter a country due to immigration issues, Discover Group of Travel Services will not be held liable.

Discover Group of Travel Services will not be held responsible for rebooking or refunding any amount from purchased tour packages if a passenger is unable to proceed with the tour due to immigration issues or other similar incidents.

Please note that it's important for travelers to comply with immigration laws and requirements and Discover Group of Travel Services cannot assume responsibility for individual travelers' immigration-related issues. It's advisable for passengers to ensure they have the necessary travel documents and comply with immigration regulations of the respective countries they are visiting.

FORFEITURE OF FREE ITEMS OR SERVICES

In cases where any free items or services are provided as part of a booking or reservation, such as complimentary meals, upgrades, or other promotional offerings, these free items or services are subject to availability and may be forfeited if not utilized during the specified time or if the booking or reservation is cancelled or changed.

Discover Group of Travel Services shall not be held responsible for any losses or claims arising from the forfeiture of free items or services due to non-utilization or changes in the booking or reservation.

All free items are not transferrable, refundable and convertible to cash.

VISA PROCESSING

Visa result must be released 90 days prior departure. In the event that visa is not yet released, rebooking should be made for a fee of Php 10,000 per person and travel date must be at least 180 days from the time of rebooking.

All costs related to visa processing will not be refundable, transferrable and convertible to cash.

Visa processing may start as early as 180 days prior departure.

It is your responsibility to provide all necessary documentation and comply with the visa application requirements of the respective embassy or consulate. Discover Group of Travel Services will assist, to the extent possible, in providing supporting documentation but cannot guarantee the success of the visa application or the refund process.

Visa approval cannot be guaranteed. When visa is not granted, the reasons of denial will not be disclosed. Discover Group is not responsible for visa result.

It is the client's responsibility to abide to the deadlines set forth by the company's representative without initiatives.

CANCELLATION FEE

For any kind of voluntary cancellations, following cancellation charges will apply:
>90 days prior departure - Php 30,000
<90 days - Forfeiture of payment

Not withstanding the provisions mentioned above, once Discover Group visa application process started, all payments are already non-refundable.

VISA REFUSAL

In case of visa refusal, Discover Group has the right to demand a copy of refusal letter to proceed with the succeeding arrangements. Discover Group of Travel Services reserves the right to verify the visa refusal by requesting appropriate documentation, such as the visa refusal letter from the embassy or consulate. The refund will only be acknowledged upon successful verification of the visa refusal.

It is your responsibility to notify Discover Group of Travel Services promptly about the visa refusal and your preference for a refund or rebooking. Failure to provide timely notification may result in the forfeiture of the options.

If your visa application is rejected or refused by the relevant authorities, Discover Group of Travel Services shall not be liable for any losses, expenses, or damages incurred because of the visa refusal, including but not limited to non-refundable bookings, cancellation fees, insurance, visa fee, or any other related costs.

In case of visa refusal, full payment made will be fully refundable 180 banking days from the time of refund acknowledgement given that all the conditions below are met:
- For clients who processed their visa by third parties or on their own, visa refusal was given more than 90 days prior departure
- Visa was processed under Discover Group

In the event that the clients received their visa refusal 90 days or less, Php 30,000 will be non-refundable.

If one or more passengers in a group booking are denied a visa and cannot participate in the tour, the group has to proceed with the tour as planned.

Visa reapplication will be allowed given that timeline allows release of visa result more than 90 days prior departure. Otherwise, rebooking will be an option for free given the tour is on the same category.

Discover Group of Travel Services will make reasonable efforts to assist the passenger(s) who were denied a visa with any necessary documentation or support for potential visa reapplication or other alternatives. However, the success of any visa application or subsequent travel arrangements cannot be guaranteed.

Please note that this clause assumes that the group has collectively decided to proceed with the tour despite the visa denial(s). It is important for passengers to assess their individual situations and make informed decisions based on their specific circumstances. Discover Group of Travel Services can provide general assistance but cannot be held responsible for the outcomes or costs associated with visa denials or individual decisions made by the group.

In the event of a visa refusal, Discover Group of Travel Services will make reasonable efforts to assist you with the refund process for any applicable bookings or reservations. Full amount of package rate may be refunded to you except costs incurred by Discover Group of Travel Services for administrative, processing, and other visa-related expenses.

If you decide to apply for a visa through another embassy or agency after a visa refusal, Discover Group of Travel Services will not be held responsible for any costs, losses, or damages incurred. You will assume the terms and conditions set forth by the respective embassy or agency, including any visa refusal policies and fees.

BOOKING CONFIRMATIONS

All bookings made through Discover Group of Travel Services are subject to availability and confirmation by the respective travel service providers (e.g., airlines, hotels, car rental companies).

To secure a booking, full or partial payment may be required at the time of reservation. The specific payment terms and requirements will be communicated during the booking process.

Cancellation policies for bookings may vary depending on the travel service providers and the type of reservation. It is your responsibility to review and understand the cancellation terms and conditions specific to your booking.

If you need to cancel or modify a booking, you must notify Discover Group of Travel Services promptly. Cancellation requests should be made in accordance with the applicable cancellation policies.

(If applicable) For Preferred packages, in the event that one or both participants are unable to join the tour, the Client may request to transfer the reservation to another individual, provided that the request is submitted no less than ninety (90) days prior to the scheduled travel date. Any name change request, once the booking has been confirmed and prior to ticket issuance, shall be subject to a name change fee of Ten Thousand Philippine Pesos (PHP 10,000.00) per participant. If cancellation was made 90 days or more before departure, Php 30,000 per head cancellation fee will apply. For 60 - 89 days prior departure, 50% cancellation charge from total amount of package per head plus applicable charges will be incurred. For cancellation made 59 days or less before departure date, full amount of total package will be charged to the said participant.

In the event that the Client requests a pre- or post-tour extension, the rebooking fee of Thirty Thousand Philippine Pesos (PHP 30,000.00) per participant shall be waived, provided that the requested extension does not exceed ten (10) days before or after the scheduled tour date and that airline tickets have not yet been finalized at the time of the request.

(If applicable) For Easy, Advanced, Deluxe, Premium or any series of products that are not guaranteed departure, in the event that target slots were not met, participants of the said tour can either re-book their tour schedule up to two (2) years period free of re-booking charges (for the similar category) and use any initial payment as travel fund to transfer to another route or travel date; or they may refund the whole amount of total package rate they paid for (without cancellation charges).

Discover Group of Travel Services reserves the right to charge a service fee for any booking changes or cancellations made at your request. The service fee amount will be communicated to you prior to processing any changes or cancellations.

In the event of force majeure circumstances (e.g., natural disasters, political unrest, airline strikes) that result in the cancellation or disruption of your travel plans, Discover Group of Travel Services will follow the policies and procedures set forth by the travel service providers and will assist you in the best possible way, but cannot be held responsible for any losses or damages incurred.

Please note that these terms and conditions are general guidelines and may be subject to specific variations depending on the nature of the booking and the travel service providers' policies. It is important to carefully review the terms and conditions associated with your specific booking before finalizing the reservation.

PAYMENT AND CANCELLATION

To secure a booking, full or partial payment may be required at the time of reservation. The specific payment terms and requirements will be communicated during the booking process.

Billing start date shall be upon signing of Booking Confirmation. In the absence of signed Booking confirmation, service shall be deemed automatically accepted upon initial payment together with the terms and conditions.

If a partial payment is made, the remaining balance must be settled based on given deadline on the booking confirmation. Failure to settle the remaining balance within this timeframe may result in cancellation charges or cancellation of all bookings reserved.

Installment Payment
Please deposit the required down payment to temporarily hold your reservation. Your booking is only guaranteed once payment deadline is met. Failure to meet monthly deadline is subject to late penalty fee and may result to booking cancellation.

Late penalty fee will be applied for participants who settled payment after agreed payment deadline. Below are the applicable penalties:
A. 1 - 15 days after due date: Php 1000/person
B. 16 - 30 days after due date: Php 2000/person
C. 31 - 45 days after due date: Php 3000/person
D. 46 - 60 days after due date: Php 5000/person
E. 61 days onwards will lead to automatic cancellation of booking. Clauses under cancellation fee may apply

Value Added Tax and other Relevant Taxes/Fees
The customer (you) acknowledges and agrees that all quoted rates provided by Discover Group of Travel Services are exclusive of the twelve percent (12%) Value-Added Tax (VAT) and any other relevant taxes that may be imposed by applicable local, national, or international taxing authorities. As such, you understand and agree that the quoted rates are subject to change upon the application of VAT and other taxes. The final amount payable by you, may increase to reflect the added tax obligations as determined by the relevant taxing authorities. As such, you agree to bear the responsibility for any additional taxes or charges that may be levied on the booking, whether they are imposed before, during, or after the booking is confirmed. This includes, but is not limited to, VAT, and any other applicable taxes or fees.

It is the client's responsibility to abide to the deadlines set forth by the company's representative without initiatives.

Mode of Payment
Bank
For your convenience, you may deposit payment through any BPI and UB branches near you. Please make sure that the account name is under Discover Group of Travel Services Incorporated since we do not accept any payment under any personal name.

Cheque
If you will issue a cheque addressed to our company, it must be cleared on or before your payment deadline.
For cheque's with 3 banking days clearing period, quoted price and availability may still vary until the day we were able to encash your payment. In this regards, applicable price increase will be shouldered by guests.

Any breakdown of tour supplies will not be disclosed to clients to protect confidentiality and competency of Discover Group's products and services.

AGE-BASED DISCOUNTS AND SPECIAL RATES

Discover Group extends preferential pricing to qualified travelers based on age classification at the time of travel:

a. Senior Citizen (60 years of age or older): Discount of Php 5,000 per qualifying senior traveler.
b. Child (2 to 6 years of age): Discount of Php 5,000 per qualifying child traveler.
c. Infant (0 to 1 year and 11 months): Flat rate of Php 50,000 in lieu of the standard package rate.

Age category shall be based exclusively on the traveler's age as of the confirmed departure date. Any change in travel date may affect the age classification and applicable discounts.

LOST LUGGAGE AND WAITING TIME

Lost Luggage:
a. If your luggage is lost during transit, Discover Group of Travel Services will NOT assist you in filing a claim with the relevant airline or transportation provider.
b. Discover Group of Travel Services will NOT cooperate with the airline or transportation provider to facilitate the process of locating and recovering your lost luggage. However, the ultimate responsibility for tracking and retrieving the lost luggage lies with the airline or transportation provider.
c. Discover Group of Travel Services shall not be held liable for any losses or damages resulting from lost luggage. Any claims, compensation, or reimbursements related to lost luggage should be pursued directly with the airline or transportation provider, as per their terms and conditions.
d. Discover Group will not be responsible for baggage handling of airlines and airport representatives.

Delayed Luggage:
a. In the event of delayed luggage, Discover Group of Travel Services will NOT assist you in filing a report with the relevant airline or transportation provider.
b. Discover Group of Travel Services will provide guidance and support throughout the process of locating and delivering the delayed luggage. However, the responsibility for handling and delivering the delayed luggage lies with the airline or transportation provider.
c. Discover Group of Travel Services shall not be held liable for any losses or damages resulting from delayed luggage. Any claims, compensation, or reimbursements related to delayed luggage should be pursued directly with the airline or transportation provider, as per their terms and conditions.
d. Discover Group will not be responsible for baggage handling of airlines and airport representatives.

Waiting Time:
a. While Discover Group of Travel Services endeavors to adhere to the agreed-upon schedules, unforeseen circumstances may lead to delays in transportation or other services.
b. Discover Group of Travel Services shall not be held responsible for any inconveniences, losses, or damages resulting from such delays, including missed connections, itinerary disruptions, or any related expenses.
c. Discover Group of Travel Services will make reasonable efforts to assist you in minimizing the impact of delays by providing appropriate guidance, information, and support.

Please note that the terms and conditions mentioned above regarding lost luggage and waiting time are in line with standard industry practices. However, specific policies and procedures may vary depending on the airlines, transportation providers, and other relevant entities involved in your travel arrangements. It is essential to familiarize yourself with the terms and conditions of the respective providers to understand their specific obligations and processes regarding lost luggage and waiting time.

CANCELLATION DUE TO PARTICIPANT MISCONDUCT

Discover Group of Travel Services prioritizes the safety, well-being, and comfort of all participants during the tour. In the event of participant misconduct, including but not limited to rudeness towards tour operators, staff members, other tour participants or being under the influence of drugs or alcohol, the following terms and conditions shall apply:

Participant Conduct: a. Participants are expected to maintain respectful and appropriate behavior towards tour operators, staff members, fellow participants, and the local community throughout the tour. b. Any form of misconduct, including but not limited to verbal or physical abuse, harassment, or disruptive behavior, is strictly prohibited.

Intervention and Warning: a. If a participant engages in misconduct as outlined in this clause, Discover Group of Travel Services reserves the right to intervene and address the situation promptly. b. Depending on the severity of the misconduct, the participant may receive a warning from the tour operator or staff members regarding their behavior.

Cancellation: a. In cases where the participant's misconduct continues despite receiving a warning, Discover Group of Travel Services reserves the right to cancel the participant's involvement in the tour. b. Cancellation due to misconduct may result in the participant being removed from the tour without any entitlement to a refund or compensation. c. Any additional costs incurred as a result of the participant's removal, including but not limited to transportation, accommodation, or alternative arrangements, shall be borne by the participant.

Participant Responsibility: a. Participants are solely responsible for their actions, behavior, and adherence to local laws, regulations, and customs during the tour. b. Discover Group of Travel Services shall not be held liable for any consequences arising from the participant's misconduct, including legal or financial liabilities.

Non-Tolerance Policy: a. Discover Group of Travel Services maintains a zero-tolerance policy towards participant misconduct, especially when it poses a risk to the safety, well-being, or enjoyment of other participants or staff members. b. The decision to cancel a participant's involvement in the tour due to misconduct is at the sole discretion of Discover Group of Travel Services.

Please note that these terms and conditions regarding cancellation due to participant misconduct aim to ensure a safe and enjoyable environment for all participants. It is essential for participants to adhere to the code of conduct, show respect towards tour operators, staff members, and fellow participants, and refrain from engaging in behaviors that may disrupt the tour experience.

DISCOURAGING CONNIVANCE AGAINST DISCOVER GROUP

Prohibition of Connivance: a. Participants or any external parties are strictly prohibited from engaging in connivance, collusion, or any illegal activities that aim to defraud, deceive, or harm Discover Group of Travel Services. b. Connivance against Discover Group includes but is not limited to acts such as falsifying information, providing false documentation, misrepresentation, or any action that compromises the integrity of Discover Group's operations.

Reporting Suspected Connivance: a. Discover Group encourages individuals who become aware of any suspected connivance or illicit activities targeting Discover Group to report it promptly. b. Reports of suspected connivance can be made to the designated contact person within Discover Group or through the official communication channels provided.

Investigation and Cooperation: a. Upon receiving a report of suspected connivance, Discover Group of Travel Services will conduct a thorough investigation into the matter. b. Individuals reporting suspected connivance are expected to provide accurate information and cooperate fully with any investigations conducted by Discover Group.

Consequences of Connivance: a. If an individual or external party is found to have engaged in connivance or any illicit activities targeting Discover Group, Discover Group reserves the right to take appropriate legal action to protect its interests and reputation. b. Discover Group may report the incident to the relevant authorities if deemed necessary.

Confidentiality and Protection: a. Discover Group of Travel Services will handle reports of suspected connivance with utmost confidentiality and respect for the privacy of the individuals involved. b. Whistleblower protection laws, where applicable, will be followed to protect individuals who report suspected connivance from retaliation or reprisals to the extent permitted by law.

Legal Recourse: a. Discover Group reserves the right to pursue legal remedies and seek damages if connivance or illicit activities against Discover Group result in financial loss, reputational damage, or other harm. b. Discover Group may also recover any legal fees or costs incurred in addressing the connivance or illicit activities.

Please note that these terms and conditions are intended to discourage connivance or illicit activities targeted against Discover Group of Travel Services. Discover Group upholds the highest standards of integrity and expects individuals and external parties to respect and adhere to these principles.

BANK DETAILS

All payments to Discover Group of Travel Services Inc. must be made exclusively to the Company's official and designated bank account(s) below.

Any payment made to any other bank account, personal account, third-party account, or unauthorized channel shall not be recognized, acknowledged, or deemed valid by Discover Group of Travel Services Inc. The Company shall not be held liable for any loss, delay, or dispute arising from payments made outside its official payment channels.

It is the sole responsibility of the client to verify the correctness of the official bank account details prior to making any payment. Only payments successfully credited to the Company's official bank account(s) shall be considered valid and binding for the purposes of booking confirmation, ticket issuance, or service delivery.
